These Terms of Service (“Terms”) govern your use of the Deskbound mobile application and related services (the “Service”).

In these Terms, “Deskbound”, “we”, “our”, and “us” refer to the operator of the Service.

By using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use the Service.

By using the Service, you represent that:

you are legally permitted to use the Service;
you will comply with applicable laws;
you understand and accept the risks associated with physical activity and device usage.

Description of the Service

Deskbound is a productivity and wellness-oriented reminder platform designed to encourage periodic movement and activity habits.

The Service may include:

reminders and notifications;
streak systems;
activity tracking;
leaderboards and friend comparisons;
progress visualization.

Deskbound is not a medical service, healthcare provider, fitness trainer, therapy platform, diagnostic tool, rehabilitation service, or medical device.

The Service is intended solely for general informational, motivational, and entertainment purposes.

Health and Safety

You acknowledge and agree that:

physical activity carries inherent risks;
you participate voluntarily and at your own risk;
you are solely responsible for your physical condition and activity decisions;
you should stop activity immediately if you experience pain, dizziness, discomfort, fatigue, numbness, strain, or medical concerns;
you should consult a qualified medical professional before engaging in exercise or physical activity where appropriate.

Do not use the Service while driving, cycling, operating machinery, crossing roads, using stairs, or performing activities requiring attention or situational awareness.

Deskbound is not responsible for injuries, health issues, accidents, falls, physical strain, repetitive strain, overexertion, distraction-related incidents, or medical complications arising from use of the Service.

Notifications and Device Usage

Deskbound may send reminders, alerts, streak updates, activity updates, friend updates, and leaderboard notifications.

You acknowledge that:

notifications may fail, be delayed, duplicated, interrupted, muted, or delivered at inappropriate times;
reminders are not guaranteed;
device operating systems and battery optimization systems may affect delivery behavior;
you are solely responsible for configuring notification settings safely.

Streaks, Activity Tracking, and Leaderboards

Streak systems, rankings, activity tracking, social comparisons, and leaderboard functionality are provided for entertainment and motivational purposes only.

Deskbound does not guarantee:

uninterrupted streak continuity;
synchronization accuracy;
preservation of activity history;
ranking accuracy;
fairness of leaderboard systems;
availability of social functionality;
accuracy of activity records.

Users are solely responsible for how they interpret or respond to streaks, rankings, reminders, activity records, and social comparisons.

User Conduct

Users may not:

abuse or exploit the Service;
interfere with the operation or security of the Service;
manipulate streaks, rankings, activity records, or leaderboard systems;
harass, impersonate, threaten, or abuse other users;
use the Service unlawfully;
attempt to bypass subscription, access, or security controls.

Deskbound may suspend, restrict, remove, or terminate accounts, usernames, or access for violations of these Terms or for operational, security, legal, fraud-prevention, or abuse-prevention reasons.

Subscriptions

Certain features may require a paid subscription.

Subscriptions automatically renew unless canceled through the applicable platform provider, including Apple App Store or Google Play.

Billing, renewals, refunds, cancellations, and payment processing are handled by the applicable platform provider and may be subject to additional platform terms and policies.

Refund requests are handled according to the policies of the applicable platform provider.

Deskbound is not responsible for payment processing errors, platform billing disputes, failed renewals, or refund decisions made by third-party platform providers.

Account Deletion

Users may request account deletion through the application settings.

Following deletion requests:

accounts may enter a pending deletion period;
personal data is generally deleted or anonymized within 30 days;
limited information may temporarily remain in backups, logs, fraud-prevention systems, security systems, or systems required for legal or operational purposes.

Certain anonymized, non-personal, or system-level references may persist where necessary to maintain platform integrity, preserve leaderboard or streak consistency, prevent abuse, or ensure service reliability.

Third-Party Services

Deskbound may use third-party providers including:

Firebase Authentication;
Firebase Cloud Messaging;
Firebase Analytics;
Firebase Crashlytics;
RevenueCat;
Hetzner hosting infrastructure.

Third-party services may independently process data in accordance with their own policies and terms.

Deskbound is not responsible for outages, interruptions, delays, data loss, payment issues, notification failures, security incidents, or other issues caused by third-party providers.

Intellectual Property

All rights, title, and interest in the Service remain the exclusive property of Deskbound and its licensors.

You may not:

copy, modify, or reverse engineer the Service;
distribute, resell, or exploit the Service unlawfully;
interfere with platform integrity or security;
use automated systems to access the Service without authorization;
attempt to bypass subscription, access, or security controls.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESKBOUND DISCLAIMS ALL WARRANTIES, INCLUDING:

MERCHANTABILITY;
FITNESS FOR A PARTICULAR PURPOSE;
NON-INFRINGEMENT;
ACCURACY;
AVAILABILITY;
RELIABILITY;
SECURITY.

Deskbound does not guarantee:

uninterrupted operation;
error-free performance;
data preservation;
notification delivery;
streak preservation;
leaderboard accuracy;
health improvements;
posture improvements;
productivity improvements;
fitness outcomes;
behavioral outcomes;
injury prevention.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESKBOUND AND ITS OWNERS, OPERATORS, AFFILIATES, CONTRACTORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR:

injuries;
accidents;
falls;
repetitive strain;
health complications;
overexertion;
distraction-related incidents;
emotional distress;
loss of data;
interruption of service;
productivity losses;
device issues;
notification failures;
synchronization errors;
third-party service failures;
indirect or consequential damages.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESKBOUND’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO DESKBOUND DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR EUR 50, WHICHEVER IS GREATER.

Some jurisdictions may not allow certain limitations. In such cases, portions of this section may not apply.

Termination

Deskbound may suspend or terminate access to the Service at any time, with or without notice, for any reason, including suspected abuse, unlawful conduct, security concerns, operational reasons, non-payment, fraud-prevention, or violation of these Terms.

Governing Law

These Terms are governed by the laws of Slovenia.

Disputes shall be subject to the jurisdiction of the competent courts of Slovenia, unless otherwise required by mandatory consumer protection laws.

Changes to These Terms

We may modify these Terms periodically.

Material changes may be communicated through the Service or other reasonable means.

Continued use of the Service after updates constitutes acceptance of the updated Terms.
